Discussion The easiest $30k this guy ever made

On October 26, 2022, the judge ruled that Walden's contact with Land should have ended when it became clear that Land was not sleeping in the park or in need of assistance, and that the city was not responsible for Walden's actions.

On November 22, 2022, the city settled the lawsuit for $30,000.

Nope, a friend of mine was relaxing in a small park area with his girlfriend, laying on a blanket with her, enjoying a nice day, and a cop came up and told them they can't sleep there, which they weren't. Pathetic that they waste their time with such shit.

You literally can’t take a nap at a beach near me. If they catch you sleeping they charge you with camping and there’s no camping allowed.

HOWEVER, and this is the craziest part, you can spend the entire night on the beach, but ONLY if you stay awake.

My friends spent the night hanging out, partying all night until dawn. Rangers came by and caught one of them with his eyes closed and they all were ticketed for camping.

Friend of mine (male) used to eat his lunch in the park every day to get away from the office for an hour. Sure enough, someone eventually called the cops on him bc he was a suspicious dude in a park where kids were playing.

He eats lunch in his car now.

62

u/1tonsoprano 26d ago

oh...that explains a lot....i saw a lot of dudes eating their lunch in cars when visiting and was wondering about that.....

94

u/iHateThisPlaceSoBad 26d ago

Nah, that's because we don't want to be fuckin bothered during the only 30 minutes of peace we have during the day.

You have to leave the workplace if you don't want to get sucked into work conversation

60

u/Turbulent_Lunch4548 26d ago

In a normal country, you can just go to a local park and have that exact peace.

That americans have to flee to their car in order to get 30 minutes free of harassment is abnormal.

My most confusing experience with police was while in a park with a mile long walking trail, just walking with someone I met on an app. Sunday afternoon, nice weather, let’s meet and just take a walk and talk.

We’re about half in, normal chit chat and walking. I don’t even remember seeing anyone else and definitely nothing unusual happened. Suddenly this cop car comes driving through the actual park, like over the grass, straight at us. Two jump out and tell us get on our knees with hands laced behind our heads and start their whole song and dance.

Why? “They got a call” and found it very odd I was wearing jeans on the walking trail.

What.

They spent about fifteen minutes searching and running warrants and generally trying to find a reason to arrest us before “warning” us and leaving. It was so weird. Got me laid though.

Make sure you don’t wear jeans in a public park. Only a hardened criminal would do such a thing.

65

u/Constant_Jackfruit21 26d ago

When i was about 18, me and my boyfriend at the time did a photoshoot of me at a local hiking trail park. We found a cheap dress at goodwill that looked vaguely fancy, got some cheap cups and apple juice to look like alcohol.

It was all fun and games until a cop rolled up and immediately started hassling us and asking questions like this. Its very odd that you're wearing clothes like this, are you runaway teens? Kept going back to the runaway teens angle. Yeah with a costume dress from Goodwill, my boyfriends digital camera, cheap plastic goblet and some apple juice - its the runaway starter kit!

Same thing happened - he was very obviously looking for something to get us in trouble for, until he finally gave up and told us we needed to leave.

Land of the free, everyone.

A friend of mine visited the US and got a nice talking to by the police for... walking down a street to get from her hotel to a store. They basically accused her of being a hooker and I imagine it would have went a lot worse if she hadn't been very white and had proof that she was a tourist.

64

u/Bocchi_theGlock 26d ago edited 26d ago

We are closing in on the future where we force people who are struggling to get by to pay for filtered air, just like water, space, food, in the richest country in the history of the world.

Everything a sale, everything a subscription. Working in a company town to pay off the debt. They are so desperate for this.

We can turn it around, say enough is enough, and start to fight back - get all the things citizens in the wealthy industrial countries have because of their taxes.

It starts with voting, and getting our friends and family to vote. Not for our moral champions that fight for us so we can sit back, but for the people who are easier for non-profits and activists to force to do the right thing. As opposed to being on defense infinitely more.

It includes being organized - at the community level, as people being exploited, in the same specific shit together. Not just as ideology, which often trends towards more highly educated, wealthier, people with free time and money who care about taking action as a good within itself, as opposed to winning material improvements in our day-to-day lives.

But as workers, neighbors, students, consumers, debtors. Leveraging the fact systems rely on our compliance and participation to operate and profit, thus we often have leverage over it by strategically and collectively withdrawing that participation.

I got stopped by a police officer for being at a disc golf course in a park in west Virginia. Finished hole 18 and on my way to my car (only one at the park) I noticed a cop car was blocking me in. Weird. When I was walking towards my car the cop got out and approached me. He immediately asked for my ID. I told him I'd comply, but what's the problem? He said "we get a lot of drug use in this park so I ran your plates and need to verify your registration." So I'm under suspicion for being at the park.

136

u/Sea-Value-0 26d ago

u/Plenty_Trick_6042 26d ago

Nope. Make each individual cop, individually liable for the dumb shit they do.

They aren't plumbers who are trying to unclog a shitter and are allowed to make an "Oopsie". They are carrying lethal firearms and can easily ruin or straight up end someone's life.

That cop should've fucked off the second he didn't wake the guy up. If he suspected he was up to no good he should've taken the initiative to phone his supervisor and confirm that what he was going to do was actually OK.

If he had to pay that 30k out of his own money he'd have done that.

And if the walking sacks of bacon who are shooting people left, right and sideways actually got put in jails with the general population you'd miraculously see a complete cessation of their weirdo nazi behavior.

"Hurr durr but we MUST be able to shoot at newborns who look at us blackishly or society will descend into anarchy!"

10

u/Young_Bonesy 26d ago

They should be required to hold individual insurance that would cover these sorts of scenarios. If they fuck up bad, premium goes up. Eventually, its to costly to maintain and you are forced out as the insurance is a requirement. The system would massively incentivize these sorts of cops to have a second thought about what they are doing because then their money and career could actually be on the line.

But then people wouldn’t get to anonymously harass homeless people at all hours of the day. And yes, this is a thing. Some drive by hero sees someone laying on the ground in a spot they don’t like. They call 911 and tell dispatch they “are not sure if they are breathing” or some other story. Dispatch sends cops and fire there code for a possible cardiac arrest or whatever the algorithm gives them based on the questions. We get there, person is obviously fine, just resting. Cops tell them to move. Everybody leaves. And then repeat 10-12 times per shift. If you don’t have the decency to ask if they are ok before calling 911, you are a fucking dork and I support you getting fined all day long.

Morgan Freeman voice: "it was in fact not how it worked"

265

u/Righteousaffair999 26d ago edited 26d ago

There was a point where this guy said I’ll speak to my lawyer and finalized the conversation that should have tipped that cop off to call a supervisor. Spideysense didn’t go, I may have fucked with the wrong guy. You can’t arrest someone for doing nothing wrong and creating imaginary charges. But the guy is probably so used to this with sovereign citizens he didn’t connect how screwed he was here.

175

u/mrteas_nz 26d ago

Also the fact that he just stood and allowed himself to be cuffed... It was like he gave the cop every opportunity, then he's like well, I guess I gotta sue these guys now.

The fact he said, “Can you articulate a reasonable suspicion?”says this guy knows his shit.

52

u/Notorious__APE 26d ago

Sidenote: It's state by state whether cops are required to actually articulate their reasonable suspicion TO YOU. In some states, it's sufficient to have reasonable suspicion without articulating (or communicating it at all) it to the suspect. And just to be clear, a cop approaching you saying "we got a call saying someone was doing X" does not meet that threshold by itself.

But yes, if someone uses the term "reasonable suspicion" and the word "articulate" is thrown in there somewhere, they likely know more about their rights than 95% of other people walking around.

As an ignorant person living in the Mediterranean, why is it illegal in the US to sleep in a park? Again sorry for my ignorance just trying to understand.

We hate homeless people (that may be universal)
… it’s getting harder and harder to simply find a public restroom in large cities for the same reason.

→ More replies (4)

44

u/Turbulent-Baker-4638 26d ago

It’s not illegal unless it’s after hours (determined by the park I guess) and you can’t sleep overnight and set up tents, etc. Maybe some other jargon about loitering. Also no homeless people because the U.S. hates what it creates.

18

u/Neonvaporeon 26d ago

It's not illegal to sleep in parks as a whole, but it's against city ordinance typically (which means illegal in that case.) When a policeman comes up to you and wakes you up, they will ask you to leave. If you don't leave, that is a violation of a lawful order, resisting without violence, civil disturbance, obstruction of peace, or some combination of those and other offenses. This is called multiplicity or multiplicious charging, and it's very common. If it goes to court, a lot of those offenses are struck down by the judge, only most fitting charges are retained.

As for why, usually to deter homeless people. A lot of Americans associate homeless people with drug users who leave dangerous litter and debris behind, or commit crimes. The objectivity of this association isn't relevant because city ordinances have the lowest bars to pass as legal in our system. Besides that, many "ordinances" aren't technically ordinances, they are resolutions, but that's getting too technical.

Our version of morality is: Poor people bad, rich people good.

Rich people are rich because they take. Seeing poor people reminds them of that truth. Rich people never like truth.

US police should be required to carry imalpractice nsurance to cover these lawsuits so that it's not on the taxpayers. That way risky cops that keep getting flagged become uninsurable and therefore can no longer work as cops.

Premiums could be reduced by attending training on constitutional subjects relating to arrest piwers.

Just a thought. After all, Doctors need to carry this stuff in the US.

"Well, someone took the time to call, so that means you get arrested."

I f'ing hate cops. And I hate the system that only stocks it with stupid people because they fear smart police would get bored with the job. So we're at the mercy of these human rejects. I actually switched careers back in the 90's because my job involved working around cops and I never felt more threatened and uneasy in my life. Dumb people with authority and guns is never a good combination.

We need to clone a couple million Mamdanis and spread them around the country. I bet he'd have standards when it came to police conduct and intelligence.

Easy not easy. Being arrested and taken to holding and processed for something that wasn't illegal is not a "easy" as the title wants to claim. Then add to this court proceedings and any outside discussions of a non-court settlement.

And did the guy get $30k above any beyond the lawyer fees? OR how much did the lawyer take out of that?

18

u/ajax151515 26d ago

Require police to carry private insurance and be licensed to practice law enforcement in the same way we require a doctor to carry private insurance for malpractice and be licensed to practice medicine. Im also fine with increasing a cops salary, but now when they fuck up their "malpractice" insurance pays up instead of the tax payer... I guarantee when a for profit insurance company is suddenly on the hook, theyre gonna find a way to straighten these cops up really quick.

59

u/pm_me_fibonaccis 26d ago

He doesn't need to give his name because they do not have reasonable articulable suspicion that he has committed, is committing, or will commit a crime.

You don't need to carry ID in any state unless you are operating a motor vehicle.

After seeing he was not committing a crime they should have fucked off.
