Unfortunately, that sworn statement from Jane Doe was the only legally relevant piece of evidence the DA had in 2024. Per the own DR'S statement:

"As I explain further below, the statement – especially as it relates to the legal definition of “lack of consent” – provides a different narrative and set of facts of the events of October 19, 2024 than those alleged in the lawsuit."

It also doesn't help that the police department didn't ask the DA about the case until November.

The other issue is why is this now coming to light two years later. Per the DA:

"As is my longstanding policy in cases such as this, we also asked CUPD to inform Jane Doe, at her option, that we would personally meet with her to explain our decision and answer any of her questions. If such a request is made, the police investigator facilitates a meeting with our office. CUPD thereafter explained the results of our review to Jane Doe. As I mentioned, in nearly two years since we were asked to review the case, neither Jane Doe nor her attorneys ever contacted the DA’s Office, not to seek answers, not to ask for reconsideration of her case, and not to suggest her sworn statement was inaccurate. Rather, I reached out to Jane Doe’s attorneys to understand and resolve this discrepancy."

This may have been a failure on CUPD to inform Jane Doe of this offer.

Whatever the case may be, this is gonna be an uphill battle for Jane Doe. I think regardless of the legal outcome of the case, the behavior set forth by the Cornell 7 was pretty egregious and shows a lack of empathy and consideration, especially that group chat.

Because it's incredibly easy for them to cite a handful of instances of false claims (because shitty people exist in EVERY group), claim it's widespread, and that this is liberal indoctrination of women in action destroying the lives of promising young men. Because conservatives THRIVE on the idea that the in-group is always under attack, and this is a direct attack on young men to them. Any constraint on the in-group is an attack. Period.

They can explain away the numbers by claiming that anything counts sexual assault to women these days. I can practically hear Jesse Watters spouting some line about how liberal women consider even looking at them to be rape, and citing some random whackjob's Xcretion as proof that this is a pervasive view. But it'll play well with the older generation who played grab-ass with women in an era where there was minimal backlash for doing so, and are angry that the world has changed and their behavior isn't tolerated in most places anymore and their grandkids look at them disdainfully when they tell those stories.

It's classic culture wars. Liberal indoctrination, the evils of feminism, citing niche views as the majority, playing to outdated views on the world...

The first two examples I can understand a little more because the person sending the threat is at least tangentially involved in whatever the person did/said. I know this will likely get some flak, but in my opinion, sexual assault cases should remain primarily confidential to protect all parties (but particularly the victim or victims) until the investigation has had time to examine the evidence. It’s far too easy to dox someone even when they’re not named.

And it always happens this way, in big institutions like universities, corporations, pro sports teams, etc.

An assault or other crime happens, and they sweep it under the rug because it would be bad for their reputation. But if it always eventually comes out later, and then they look so much worse than if they had dealt with it properly in the first place.

Your overall point is good … but I’d quibble insofar as I don’t think it always eventually comes out, sadly I suspect it is only sometimes.

We’re just seeing the cases where the institutions are unable to sweep it under the rug for good. In other cases unfortunately they likely succeed. Sometimes there isn’t enough evidence or the poor victim is too ashamed or traumatised or intimidated to be able to try.

Unfortunately I suspect the problem is a lot larger than just the cases where the coverup fails might suggest.

She still likely would have sued. Its a civil suit for money and she's suing the school, the fraternity, her own sorority, and a couple campus bars.

Also its not like Cornell did nothing. They investigated the event with over 30 witnesses, more than 10 hearings, kicked off the fraternity, expelled two of them and suspended the others based on each person's involvement according to their investigation. All that even though the DA said there wasnt a crime to investigate.

The obvious problem with this, is that we are already publicly accusing people of all sorts of crimes and also of things that are not even crimes, so it would be impossible to enforce either legally, or even on a level of expected civic virtue, that accusing people of one specific probably illegal behavior is uniquely taboo.

Like, I can accuse a politician of having used the N-word in private, or of embezzling, or being gay, or committing adultery, or doing insider trading, but I can't accuse them of getting handsy with his female staff, on the off chance that a court might decide that his well-documented sex pest behavior didn't pass the limits of legal "sexual assault", therefore he is Not Guilty, nothing to see here?

There’s also been reports of other men being threatened and doxxed online after being misidentified as one of the accused simply bc they share the same name, including an active duty Marine from NY State. Point being: Confidentiality of all parties in cases like this , at least leading up to official charges being filed, is important for many reasons and does not simply equate to providing unjust protection and anonymity for the accused. Keeping all parties anonymous protects the victim from being identified and the general public as well.

I wonder why sexual crimes are so underreported on college campuses (and in general). Cornell is my alma mater and they have done an excellent job thus far of maintaining that particular status quo.

NYT published an article today detailing the outcomes of 2024 investigation. Six of the seven were found culpable for sexual assault and/or attempted exploitation. Two were expelled, two suspended and permitted to return, and two made to write essays and attend training. The seventh graduated before the investigation was complete and was temporarily banned from campus as punishment, because temporary suspensions for students accused of misconduct and while university investigations are pending are only for student protesters and not accused rapists, apparently.

If the allegations in the new lawsuit are false accusations, as trolls and apologists are screaming online, then the conspiracy has to go to the very top of Cornell. Incredible coordinated scheming from Jane Doe, her attorney, and the university admin, especially because the Cornell investigation concluded over a year before the lawsuit was filed. /s

Because in college is always about reputation. A bit off topic but in my university I just found out there is a professor that sends private messages to students insulting them and treating them like they are dumb because they question him. I was in shock, I though "get, wtf? Why isn't he fired?" Of course any students that would start shit would probably fail the class. But guess what this has happened for decades, students always complaint about bad teachers and the university nearly 100% of the time ignored it unless they get sued. Even better, I've gotten a ton of e-mailed about professors concerned about AI usage, meanwhile we some times pay over 2,500K each one in classes where the professor just makes just read a lot, memorize a bunch of crap and then give us the same test from 2021 that he/she forgot to change the date on. So yes, I'm not surprised rape, sex assault, harassment, bullying, I'm not surprised everything is underreported in universities. Some of those frat houses probably have blood in their hands.

Isn’t this the case where there’s documentation in her texts indicating she consented to everything except the specific things they didn’t do (threesome, anal vs foursome, etc) and only changed her mind on it more than a year later.

If it is that case and I’m not mistaken it seems more like using sexual assault accusations as a weapon for retribution more than as a legitimate belief she was victimized. Which is frankly one of the scummiest thing imaginable.

That isn’t to say she should be harassed or threatened, but given the circumstances of using the legal system as a weapon against people who respected her wishes in that moment, frankly I do think she’s a horrible person.

No, I don’t give a shit about waiting for a conviction from a system that benefits rapists and doesn’t hold them accountable. They’re rapists. They should be shamed and harassed for raping a woman and I don’t need the legal system to tell me that.

Even if they aren’t found guilty of a crime, they behaved very unethically. There are social consequences for their behavior.

Edit: the down voters need to go on a list. You really think it’s acceptable for men to invite their friends to gang rape an incapacitated woman.
