I'm betting that's against policy. My airline wouldn't let anyone but FAa and pilots sit in those. Also, if it was a completely full flight, the jump seats might have had non-rev crew.
PIC still has final say. Could have asked the jumpseat rider to change due the circumstances. Besides that the police should have met the flight on arrival. Sounds like the crew dropped multiple balls on this one.
