RFE EP Attorney Strategy for NIW RFE Response
Hi,
this is my very first post, but I’m honestly pretty devastated and extremely disappointed with Ellis Porter’s strategy for my RFE response.
For reference:
I filed my initial EB-2 NIW petition in 2024, with 36 citations and no letters of recommendation.
My PE: developing artificial intelligence methods for medical imaging, specifically related to immunotherapy and tumors.
I received an RFE in 2026 challenging** **all three prongs, after waiting approximately two years.
Since filing, my profile has improved significantly. I now have 119 citations, 5 letters of recommendation (which I prepared myself, although they discouraged me from doing it! Saying it will distract the officer!!!), a postdoc offer, and 9 peer-reviewed papers.
I provided all of these documents and information to my attorneys for the RFE response.
Today, I received their response template, and I’m honestly shocked by the strategy they’re taking.
Their response basically argues that the officer’s statements are inaccurate and that they disagree with essentially all of the officer’s points. That part wasn’t necessarily a surprise, I already knew they tend to take a very argumentative approach.
What I did expect was to be able to provide my comments and have them revise the response accordingly.
Instead, when I asked about incorporating my arguments, they told me that this is their strategy. Their position is essentially that all of the relevant evidence was already included in the original petition and that the officer should simply look at it again.
I’m extremely dissatisfied with this approach. I have substantially stronger evidence now than I had in 2024. Yet the response seems to rely heavily on arguing that the officer was wrong rather than clearly presenting the new evidence and explaining how it addresses each issue raised in the RFE.
Has anyone experienced something similar with Ellis Porter, particularly with an RFE response? Would you push back and insist on revisions?

Forget them. Go for a law firm that provides RFE response
