It would depend on the totality of the circumstances. If the evidence of the crash matches the statements of the drivers, it's hard to change your story later when you get a ticket for something you didn't realize was unlawful. Anything you say can be used against you in court.
If you tell an investigating officer that you're cruising down the hill in neutral and then couldn't avoid a crash because your vehicle is not in gear and then you get a ticket for coasting in neutral it's kind of hard to recant that to oh, I bumped my shifter somehow.
My counter to "accidentally bumping the shifter into a different gear or gear setting" would be careless driving which is a higher level offense that carries license suspension possibilities...

In that instance I feel like it would be super hard to prove the person didn’t just knock it into neutral during the accident tho. What a weird law.
