Was thinking the same thing. She would not have reasonably expected anyone to ever see what she had written. That intent is necessary for something to be a threat.

She was absolutely unreasonable for thinking the chatbot, where she had to agree to terms including that talk of violence would get flagged, would be private.

I can yell that reddit is my diary, doesn't make it reasonable to expect privacy.

I expect no one on the court, jury, or here in the comments has any idea how any of this tech works. I think that in and of itself should be a good enough defense, especially when the law is clearly stating a public statement.

Someone having access to private messages is not the same as making a public proclamation.
