If their actions doesn't come under qualified immunity, you can sue them personally. That's what they are most scared of

Or how about if they are the officer responsible that leads to a suit that results in a payout, they lose their job, pension, and any other benefits. Not just a slap on the wrist, and a paid vacation.

While your idea would be a deturant, it would not solve anything at all.

Police should carry insurance to maintain their status. If they get sued, it comes out of the insurance and not the tax payer.

Most cops don't make much. Insurance covers that gap. Their premium goes up if they lose a lawsuit attached to their name. Eventually, it cost too much to retain bad cops. That way they can't reshuffle bad cops to new locations.

The reason this won‘t happen is because lawmakers are too afraid that cops would just twiddle their thumbs too afraid to make an honest mistake.

Better training then? Doctors are held under stricter guidelines and get sued, why cant police officers that carry a deadly weapon be held under higher standards?

Because politicians need them to keep the „plebs“ in check and if they could be held accountable their whole power structure would collapse

Politicians are afraid if this were instituted, cops would become less corrupt. And then their own corruption would get exposed.

Should just do away with qualified immunity and require them to have indemnity insurance.
Once they fuck up and become uninsurable the system heals itself with zero oversight.
No insurance, no badge. Simple.

Lol, it's the Supreme court that came up with qualified immunity, it's just hard to remove.

What we can do is have something like "malpractice insurance", so you deduct the insurance from the salary of a cop.

You just increase the insurance with every succesful claim and eventually the cop will just quit on his own.

They approved “qualified immunity”, but government has twisted it into immunity for everything! “Qualified” was supposed to mean that they were working under the departments direction and following the law and policies of the department. The police and courts have turned that into “no one told them they could not do that specific thing that any normal person would consider illegal or wrong!”

The settlement should come out of the Police Union funds. That will make an actual deterrent.

The individual cop who arrested her maybe followed procedure, but the residue should have been tested immediately. Someone made that mistake and ought to personally pay for it.

Do you think the cop who arrested her would have made sure it was tested immediately, if we had a malpractice insurance system & he had one single financial incentivize to make sure it was a valid arrest?

They each should have their own Insurance. End Qualify Immunity. If they can't get Insurance, they can't be a cop!!! That would stop these tyrants getting away with all this crap, or fleeing to another police department.

Insurance is a clever way but i’d rather the cops simply get arrested and thrown in jail.

And once convicted, subject to lawsuits. Make em pay

We need to have a national insurance like scheme for cops. Let the actuaries sort them, price the bad ones out.

Same for guns IMO.

Sure. But also they need to be arrested for crimes. I like both.

Cops need consequence.
